Privacy notice

Last updated:

At 8A Soluciones, we care about your personal data. This notice explains what data we process, what we use it for, and how you can exercise your rights, including your ARCO rights (access, rectification, cancellation, and opposition), under the LFPDPPP, Mexico's Federal Law on the Protection of Personal Data Held by Private Parties.

Who is responsible for your data

The controller responsible for processing your personal data is:

Legal name
8ASOLUCIONES, S.A. de C.V.
Trade name
8A Soluciones
Address
Parque Industrial Salitrillo, postal code 37210, León, Guanajuato, Mexico

Personal data we process

To handle your request, we process the following personal data:

  • Identification and contact data: name, email, phone, and company (optional).
  • Project data: product of interest and the description you share with us, such as product to protect, dimensions, weight and approximate quantity.
  • Submission data: the IP address from which you send the form.
  • Browsing data: the data obtained by the cookies and technologies described in Cookies and tracking technologies, only on the terms described there.

If you contact us by WhatsApp, email, or phone, we will process the data you share with us through those channels for the same purposes.

We do not process sensitive personal data, such as data that reveals your health, ethnic origin, beliefs, or political opinions, and we do not request financial or asset information. Please do not include it in your project description.

How we use your data

Necessary purposes

We use your data to:

  • Respond to your quote request.
  • Contact you to clarify the details and send you the quote.
  • Follow up on the project you requested.
  • Protect the form against automated submissions and abuse by limiting submissions per IP address and with reCAPTCHA.

These purposes are necessary to handle the request you make to us and give rise to your relationship with us, so they do not require your consent.

Purposes that require your consent

We do not use your name, contact details, company, or project description for purposes that require your consent: we will not use them to send you promotions, advertising, or news. If we ever want to use your data for a different purpose, we will ask for your consent first.

With browsing data, and only if you accept the corresponding category of cookies, we carry out these purposes, which are not necessary to handle your request:

  • Analytics: measure how many people visit the site and which sections they view, with Google Analytics.
  • Advertising: measure which ads generate quote requests or WhatsApp messages and show you 8A Soluciones ads on other websites and on Facebook and Instagram based on your visit (personalized advertising or remarketing), with Google Ads and the Meta pixel. For this, we transfer data to Google and Meta, as explained in Service providers and transfers.

If you accept analytics or advertising cookies, Google records that you submitted the quote request form and the product of interest you chose; if you accept advertising cookies, Meta records only that you submitted it. Neither records your name or contact details.

To refuse these purposes, simply do not accept those categories. You can withdraw your consent at any time with the “Configure cookie preferences” button in the Cookies and tracking technologies section or with “Cookie preferences” at the bottom of the page. Your choice is stored only in your browser, so you change it there, in each browser you use; if you need help, write to us at [email protected]. Refusing does not affect how we handle your quote request.

Retention

We keep your data only for as long as necessary for the purposes of this notice and to comply with the legal obligations that apply; after that, we block and delete it.

Cookies and tracking technologies

The site uses cookies and your browser's local storage. Necessary cookies always work; analytics and advertising cookies are only activated if you accept them, and you can change your decision at any time.

Analytics and advertising cookies obtain data automatically while you browse: cookie identifiers, IP address, browser and device type, pages visited, date and time of the visit, the website or ad you came from, and actions such as submitting the quote request form (with the product of interest you chose) or clicking the WhatsApp, email, or phone links.

reCAPTCHA analyzes browser and device data, including your IP address, and your interaction with the form to tell people apart from automated programs.

Google may also use cookies on its own domains to run reCAPTCHA when you use the form and, only if you accept advertising cookies, to show you personalized ads. Meta may also use cookies on its own domains, only if you accept advertising cookies, to show you personalized ads on Facebook and Instagram.

How to disable them

You can accept, reject, or change analytics and advertising cookies at any time from the preferences panel:

You can also block or delete cookies and site data from your browser settings. If you block necessary cookies, the form may not work; in that case, you can write to us by email or WhatsApp.

Service providers and transfers

Disclosures to processors

To operate the site, we share data with providers that process it on our behalf and according to our instructions (processors), in or outside Mexico:

  • The site's hosting provider, where the form is processed.
  • The email provider, which delivers and stores quote requests.
  • Google, as the provider of reCAPTCHA, Google Analytics, and Google Tag Manager, on the terms of the cookies section.

These disclosures do not require your consent. Even so, Google Analytics only loads, and only receives data, if you accept analytics cookies (the analytics purpose requires your consent).

Transfers

If you accept advertising cookies, we transfer to Google (Google LLC, in the United States, or the Google company with which we have the Google Ads contract, such as Google Operaciones de México, S. de R.L. de C.V.) the browsing data described in Cookies and tracking technologies, including the signal that you submitted a quote request (with the product of interest you chose) or clicked on WhatsApp. Google receives it as an independent controller, not as a processor, and processes it under its own privacy policy: by accepting this transfer, you agree that it may use it to measure the results of ads, including ours; personalize the ads and content it shows on its services and on its partners' websites and apps, for example, 8A Soluciones ads based on your visit (personalized advertising or remarketing); and improve its products. See how Google uses information from sites that use its services on its website.

If you accept advertising cookies, we transfer to Meta Platforms, Inc., in the United States, the browsing data described in Cookies and tracking technologies, including the signal that you submitted a quote request (without the form data) or clicked the WhatsApp, email, or phone links. Meta receives it as an independent controller, not as a processor, and processes it under its own privacy policy: by accepting this transfer, you agree that it may use it to measure the results of ads, including ours; personalize the ads and content it shows on and off its products (Facebook, Instagram, Messenger, and other apps and websites in the Meta network), for example, 8A Soluciones ads based on your visit (personalized advertising or remarketing); and improve its products. See Meta's Privacy Policy on its website.

Your acceptance: you accept or reject these transfers with the Advertising category of the cookie preferences panel: “Accept all” accepts them and “Reject” rejects them. If you do not accept them, they do not take place: neither Google Ads nor the Meta pixel loads in your browser. You can withdraw your acceptance at any time, without retroactive effect, from the same panel: your choice is stored only in your browser, so you withdraw it there, in each browser you use. By email, at [email protected], you can ask us for help or exercise your ARCO rights (for example, cancellation or opposition) over the data we do keep, such as the data in your quote request.

Except as described above, we do not transfer your personal data to third parties. We could only do so without your consent in the cases permitted by article 36 of the LFPDPPP, Mexico's Federal Law on the Protection of Personal Data Held by Private Parties, for example, when a law provides for it, when it is legally required for law enforcement or the administration of justice, or when it is necessary to recognize, exercise, or defend a right in a judicial proceeding.

How to limit use or disclosure

In addition to exercising your ARCO rights, you can limit the use or disclosure of your data:

  • By writing to us at [email protected] to tell us which use you want to limit. We will reply within the time limits in the ARCO rights section.
  • By rejecting or disabling analytics and advertising cookies from the preferences panel or your browser settings.
  • By sharing only the necessary data: company and product of interest are optional.

ARCO rights and withdrawal of consent

You have the right to:

  • Access: know what data we have about you and how we process it.
  • Rectification: correct it if it is inaccurate, incomplete, or out of date.
  • Cancellation: ask us to delete it from our records.
  • Opposition: object to its processing for a legitimate reason.

These are your ARCO rights, named for their initials in Spanish. You can also withdraw the consent you have given us at any time, without retroactive effect. If you withdraw your consent or cancel your data while we are handling your request, we may not be able to continue with it.

How to submit your request

Email for requests
[email protected]

The person we have designated for personal data protection handles the requests. Your request must include:

  1. Your name and an address, email, or other means to receive our response.
  2. A copy of your official identification or, if a representative acts on your behalf, the documents that prove their identity and their authority to represent you.
  3. A clear and precise description of the data on which you want to exercise your right (not necessary if you request access).
  4. The right you want to exercise or what you are requesting.
  5. Any other information or document that helps locate your data.

If you request a rectification, also indicate the corrections to be made and attach the documents that support them. To withdraw your consent, follow the same procedure. Your cookie choice, and with it your acceptance of the transfers, is changed in the cookie preferences panel, because it is stored only in your browser.

Time limits and costs

We will send you our response within a maximum of 20 business days from the day we receive your request. If it is granted, we will make it effective within the 15 business days following our response. Both periods may be extended only once for an equal period when the circumstances justify it. If you request access, we will provide your data in electronic documents or simple copies, once your identity has been verified.

Exercising these rights is free of charge; we could only charge you for reproduction, copying, or shipping costs. If you are not satisfied with our response or do not receive it, you can go to the authority.

We may modify this notice due to changes in the law, in our services, or in the site's tools. We will publish any change on this same page, with its last updated date at the beginning and at the end of the notice. We recommend that you review it periodically.

If a change involves using your data for a new purpose that requires your consent, we will ask for it first. If the cookies that require consent change, we may ask you for your preferences again.

Authority

The authority that oversees compliance with the LFPDPPP, Mexico's Federal Law on the Protection of Personal Data Held by Private Parties is the Secretaría Anticorrupción y Buen Gobierno (Mexico's Ministry of Anti-Corruption and Good Governance). You can file a data protection request with it within the 15 business days after we send you our response or, if you do not receive one, after the deadline for our response expires.
